The topless coyote Songkran dancers story

I am sure you have seen the story about the three teen girls who danced topless on top of cars in the Silom area during Songkran celebrations. There was big outrage about it when (censored) video was shown on Thai TV. Here is a video clip from YouTube that is even more censored than what I saw on TV.

Turns out the three girls were only 14, 15 and 16 years old. So young, and not dancers from the nearby Patpong bars as many people first thought. They ended up turning themselves in and paying a 500 baht fine, which seems about right. Probably similar to what a girl in the U.S. would pay for dancing topless on a car in public ‘cuz public nudity is illegal there, too.

The disturbing part of the story for me is that the people who uploaded the video clips to the internet face five years in prison for violating some part of the computer crime law.

    “The disturbing part of the story for me is that the people who uploaded the video clips to the internet face five years in prison for violating some part of the computer crime law.” I agree that that punishment doesn’t seem to fit the action – but in the USA, they possibly could have been charged with distributing child pornography.

    I understand the potential issue re “child pornography,” but I’m not sure it could be applied in this case…

    First, the detail of the ages of the girls only came out AFTER the fact… Whomever was shooting the video, and whomever posted it to the Internet, would have had no way of knowing the ages of the girls involved.

    And, based on the contents of the video, I’d think most people viewing the goings on would have had reason to believe that the girls involved were older than they were…

    Indeed, given the Silom location, as Ms. AS pointed out, and the dancing mannerisms of the girls, most folks probably would have assumed they were on leave from jobs nearby at Patpong.

    Some news reports on this issue have quoted the police as saying they were going to go after the videographer and the Internet poster for violating the GIRL’s rights…. the same girls who were fined by police for breaking Thai law in public on a public street.

    And what, by the way, were the police doing the whole time the girls were giving their very public show on top of the cars??? And please don’t anyone make the argument that no police would have seen what was going on…

    Appearing topless in public practically anywhere in the U.S., will cost the person approx. $150. which is about 4500 baht. Not quite the same as 500 baht. Even in the U.S., most police would enjoy watching 15, 16 year old girls dancing topless. :-) However, in the U.S., they would have watched for a little bit, smiled, then ask the girls to put their clothes back on and oh, by the way, please get in the back of the police car, your under arrest for public nudity. thank you.

    I have to agree with poster # 3’s input. I have seen the uncensored version and I would of never guessed they where that young. Not at all. So when does the parental values come into all this??? As a single parent who raised two daughters on my own, through many a bad time and good times, they learned personal moral values. Here and as in my home country moral values are falling away. And no, I am not some do gooder. Far from it.

    @thaiguyinla – I realize that even within the US, there are variations in how strictly the law is applied, but if the posters posted video or pictures of minors, they violated the law, strictly speaking. Remember the phrase, “Ignorance is no excuse.” It was coined, I believe, specifically in reference to the law.
    I’m no lawyer, but I am an amateur photographer, with some little acquaintance with privacy issues. It’s my understanding that, in the US, if the girls were dancing in public, they had no expectation of privacy, and that their dancing could be construed as “newsworthy,” at least in the first postings. So their suit against the videographer would be denied. I’ll be interested to see what happens.
    Good question about the police.

    John, from the various media reports, the girls involved are NOT trying to press any invasion of privacy case against whomever was involved in the videos…

    It’s the police who are talking about that being the basis for how they, the police, plan to proceed against those involved in the video. Legally in Thailand, the police can pursue cases on their own, even if the alleged victims aren’t supporting that.

    In the U.S., in recent years, many states have passed laws against shooting photos or videos of minors without parental agreement — in large part because of the potential exploitation issue.

    However, I’m not sure Thailand has ever passed such a law. And, additionally, part of establishing guilt in many crimes is that there be some intent on the part of the accused.

    They might be able to get them under Thailand’s pretty broad computer crimes law, at least whomever posted the videos…. But as for invasion of privacy for the girls, given the circumstances, that seems a pretty LONG stretch.

    So the age is something that matters? What if they were, say, 25 year old? I thought they would get arrested and fined too, right? I think public nudity is something unacceptable for Thai culture. Or am I wrong?
